Welcome to ELMNT. These Terms of Service govern your use of our website and the purchase of products from ELMNT. By accessing our website or placing an order, you agree to be bound by these Terms

2. Eligibility

By placing an order through our website, you confirm that:

The information you provide is accurate and complete.
You are purchasing products for personal, non-commercial use.

3. Products

We make every effort to display product descriptions, colours, sizing and images as accurately as possible. However, slight variations may occur due to screen settings, photography, or manufacturing differences.

All products are subject to availability.

4. Pricing and Payment

All prices are displayed in your local currency and include applicable taxes unless otherwise stated.

We reserve the right to change prices at any time, but changes will not affect orders already accepted.

Payment must be made in full at checkout through our approved payment providers.

5. Order Acceptance

After placing an order, you will receive an order confirmation email. This does not constitute acceptance of your order.

A contract is formed only when your order is dispatched.

We reserve the right to refuse or cancel orders where:

Products are unavailable
Pricing errors occur
Fraud or unauthorised activity is suspected

If payment has been taken for a cancelled order, a full refund will be issued.

6. Shipping and Delivery

We currently ship to addresses within the United Kingdom, United States of America, Australia, New Zealand, and Canada.

Estimated delivery times shown at checkout are estimates only and may vary.

As some products may be fulfilled by overseas suppliers, delivery may take longer than standard domestic shipping.

We are not liable for delays caused by customs, couriers, force majeure events, or circumstances beyond our reasonable control.

Risk in goods passes to you upon delivery.

7. Cancellations (14-Day Cooling-Off Period)

Under UK consumer law, you generally have the right to cancel your order within 14 days of receiving your goods for any reason.

To exercise this right, you must notify us within 14 days of delivery.

Returned items must be:

Unworn
Unused
In original condition
With original packaging where reasonably possible
All tags still attached to the item(s)

Unless the item is faulty or incorrect, return postage costs are the customer’s responsibility.

Refunds will be processed in accordance with applicable UK consumer law.

8. Faulty, Damaged or Incorrect Items

If your item arrives faulty, damaged, or incorrect, please contact us promptly at support@elmntapparel.com with your order number and any images of the defected item(s)

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

9. Returns and Refunds

Refunds, where due, will be issued to the original payment method.

We reserve the right to reduce refunds where returned goods show handling beyond what would reasonably be permitted in a retail store, where permitted by law.

10. Intellectual Property

All content on this website, including text, graphics, logos, images and branding, is the property of ELMNT and may not be copied, reproduced or used without permission.

11. Acceptable Use

You agree not to:

Use the website unlawfully
Interfere with site security
Submit false or fraudulent orders
Attempt unauthorised access to our systems

12. Limitation of Liability

Nothing in these Terms excludes liability that cannot be excluded under law, including liability for death or personal injury caused by negligence, fraud, or breach of statutory consumer rights.

Subject to the above, our liability shall be limited to the purchase price paid for the relevant goods.

13. Force Majeure

We are not responsible for failure or delay caused by events beyond our reasonable control, including natural disasters, transport disruption, strikes, pandemics or governmental action.

We strive to display accurate descriptions, images and prices. Colours and finishes may vary slightly dependent on device screens and lighting. Product availability and pricing are subject to change without notice.

16. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the courts of England and Wales, unless mandatory consumer law provides otherwise.
